Our Lead Attorneys Settle Cases for National Litigation

SAN FRANCISCO, May 1, 2014 – Levin Simes LLP announced that an agreement in principle has been reached to settle approximately 20,000 claims related to vaginal mesh products sold by American Medical Systems, Inc. (AMS), a subsidiary of Endo Pharmaceuticals. These include claims of women represented by Levin Simes and several other law firms. Endo Pharmaceuticals will pay approximately $830 million for resolution of those claims.

William Levin of Levin Simes, one of the lead negotiating counsel, engaged in talks with Endo Pharmaceuticals since the fall of 2013 to create the structure and process to negotiate settlement of these claims and the claims that remain against AMS. The result is a resolution framework that allows for the categorization of claimants’ injuries based on proof of implant with an AMS product, operative reports and additional medical records with an overall dollar settlement negotiated for each firm.

“We are very happy to have helped to obtain compensation for so many women who have been injured by transvaginal mesh products, including many of our own clients. The negotiations have been difficult and complex but I would like to compliment AMS for being the first major manufacturer to step up and take responsibility for resolving the cases. We would also like to thank Judge Goodwin for his extraordinary efforts in supervising these negotiations as well as our co-negotiating counsel, Joe Rice and Henry Garrard,” said Levin.

The Honorable Joseph R. Goodwin of the Southern District of West Virginia supervised the negotiations. Joe Rice and Henry Garrard served as co-negotiating Counsel with Levin. Amy Eskin of Levin Simes serves as co-lead counsel of MDL 2325 In Re American Medical Systems, Inc. Pelvic Repair Systems Products Liability Litigation.

“This settlement is the beginning of a process of closure for these women. We are happy that we have been able to obtain compensation for many who have suffered life changing injuries as a result of being implanted with pelvic mesh. Their courage in seeking redress for these very personal injuries is an inspiration to all of us who fight for them on a daily basis and give voice to them in Courts around the country. We will continue to prosecute these cases on behalf of injured women throughout the country,” said Eskin.
