What Inappropriate Behavior Qualifies for an Uber Sexual Harassment Lawsuit?

Uber’s safety reports break down sexual assaults into the following sub-categories:

●      Non-consensual sexual penetration

●      Attempted Non-consensual sexual penetration

●      Non-consensual kissing of a sexual body part

●      Non-consensual touching of a sexual body part

●      Non-consensual kissing of a non-sexual body part

The report has categorized these assaults in such a way as to not include all categories of crimes.

Please Note: These categories and descriptions are how Uber categorized assaults in their report, Levin Simes does not use this system to categorize assaults. We have multiple disagreements with this structure, but this is how the data was structured and released. If you are a survivor and wish to discuss your options with us, please reach out to us at (415) 426-3000 or info@levinsimes.com.

What Uber’s Third Safety Report Reveals

Uber's third U.S. Safety Report covers incidents reported from January 1, 2021, to December 31, 2022. This report details thousands of serious safety issues that happened during that two-year period.

When we look specifically at sexual assault, Uber's latest report documented:

  • 2,717 total reported incidents across the five most serious categories of sexual assault.
  • 355 of these reports involved non-consensual sexual penetration (rape), which is the most severe category.
  • 1,401 reports were for non-consensual touching of a sexual body part, making it the most common type of sexual assault reported.
  • There were also 258 reported incidents of non-consensual kissing of a sexual body part, and 338 reports of non-consensual kissing of a non-sexual body part.
  • Finally, 338 incidents of attempted non-consensual sexual penetration were reported.

It's important to note that Uber calculates these incidents as happening in a very small fraction of its total trips (around 1 in 700,000 trips for all sexual assault categories). However, even at these rates, with millions, it still translates into countless real-life incidents.

Beyond sexual assault, the report also highlighted other serious safety issues:

  • There were 153 individual deaths across 127 fatal car crashes related to Uber rides.
  • Tragically, fatal physical assaults nearly doubled since Uber's previous report, with 36 reported incidents that led to a death.

These detailed numbers confirm that sexual assault and other serious safety incidents are a continuing concern on Uber’s platform.

Sexual Assault Categories as Defined by Uber:

The March 2025 Uber Ruling and Growing Lawsuit Numbers

March 2025 saw a huge win for Uber sexual assault survivors across the country. The U.S. 9th Circuit Court of Appeals made a landmark decision that could change how many of these cases move forward.

Uber had been trying very hard to make sure that each sexual assault lawsuit was handled completely separately. They argued that a clause in their user agreement said that users couldn't join group lawsuits.

Uber wanted to force thousands of individual cases, which would make it incredibly difficult and expensive for survivors to pursue justice against a huge company like Uber.

However, the court sided with the survivors, ruling that federal law allows these similar cases to be brought together. This is a massive breakthrough because many cases can be combined into what's called a Multidistrict Litigation (MDL). This allows survivors to work together, share information, and present a much stronger, united front.

Latest Number of Uber Sexual Assault Lawsuits

As of June 2025, there are now over 2,200 sexual assault lawsuits consolidated in the federal Uber MDL. We've also seen over 600 additional sexual assault lawsuits against Uber drivers that are grouped together in California state courts.

This number continues to climb every month as more and more survivors feel empowered to seek justice.

What Does an Uber Sexual Assault Lawyer Do For Your Case?

An Uber sexual assault attorney can provide services like:

  • Gathering evidence: Your lawyer can work to gather evidence such as witness statements, medical records, and police reports that can support your claim and help to establish liability on the part of the driver and the Uber Technologies corporation.
  • Building a strong case: With the evidence gathered, your lawyer then uses their legal training to build a strong case that supports your compensation demand. We can also represent you in court and negotiate directly with Uber’s legal team or insurance representatives to obtain a fair settlement as quickly as possible.
  • Protecting your rights and reputation: Your lawyer can ensure that your legal rights are protected throughout the legal process, including blocking inappropriate investigations into your personal life. We can also help you navigate any attempts at defamatory arguments made by the opposing party.

An Uber sexual assault lawyer can serve as a critical buffer between you and the triggering memories of the assault you survived. Securing justice should not retraumatize you by causing additional distress — our attorneys are your frontline warriors against opposing counsel and the perpetrator who harmed you.
