August 10, 2018: A jury in San Francisco found Monsanto liable for the terminal cancer of a school groundskeeper who was diagnosed with non-Hodgkin Lymphoma after using Roundup. The jury awarded damages for causing his terminal cancer as well as punitive damages against Monsanto after learning of their behavior and their failure to warn about the risk of cancer.
Non-Hodgkin Lymphoma Lawsuit
Dewayne Johnson sprayed Roundup, which contains glyphosate and is made by Monsanto, around school campuses in the Benicia Unified School District to control weeds. Dewayne was hired as the integrative pest manager, but after using Roundup for several years, he noticed lesions on his skin. Mr. Johnson reached out to Monsanto directly to inquire if his new skin condition was due to exposure to Roundup.
Monsanto internally discussed his inquiry but did not warn him about the dangers of non-Hodgkin Lymphoma from Roundup. In fact, the jury learned that Monsanto did not respond to Mr. Johnson’s inquiry at all. Mr. Johnson continued to use the product and was soon diagnosed with a terminal case of non-Hodgkin Lymphoma. The jury awarded $250 million in punitive damages after learning all the details of Mr. Johnson’s use of Roundup, his attempt to learn the reason behind his skin lesions, his diagnosis of non-Hodgkin Lymphoma cancer, his terminal diagnosis and estimated short time left to live, and Monsanto’s failure to warn consumers or even Mr. Johnson when he directly inquired about the risks of Roundup exposure.
The punitive damage verdict for Monsanto’s behavior is on top of the $39 million in damages awarded to Mr. Johnson for his terminal cancer diagnosis from Roundup.
