Uber and Lyft Drop Mandatory Arbitration for Sexual Assault

Uber and Lyft announced an end to their previous practice of forcing survivors of driver on passenger sexual assault into mandatory arbitration.  Uber and Lyft’s mandatory arbitration clauses required survivors of sexual assault to handle resolution  out of court.  This means survivors could not sue due to the terms of service inside the app.

Uber Mandatory Arbitration

Uber and Lyft announced they would drop a portion of their terms of service that restricted survivors of ride share driver sexual assault from filing lawsuits. Uber’s Chief Legal Officer, Tony West, stated “will no longer require mandatory arbitration for individual claims of sexual assault or sexual harassment by Uber riders, drivers or employees.”

6,000 Uber Sexual Assaults – CNN Finds 103 Uber Drivers Accused of Sexual Assault or Abuse

A CNN report found at least 103 Uber drivers in the U.S. have been accused of sexual assault, rape, attempted rape, or sexual harassment of passengers within the last 4 years. Dozens of convictions have occurred for crimes related to sexual assault or kidnapping.

Pressure on Uber and Lyft lead to Uber releasing data showing 6,000 assaults over two years. Categories included kissing a body part, touching a sexual body part, attempted penetration and sexual penetration (rape).  Both drivers and passengers were assaulted, although the passenger was more commonly the survivor of an assault.

Neither ride share company publicly reveals the number of drivers accused for assault, battery, or harassment on passengers, but pressure is mounting for the services to disclose more to the public.  The companies’ previous practice of mandatory arbitration ensured these events did not become public.
